2. The petitioner seeks regular bail in connection with Excise P.S. Case No. 278 of 2024 registered for the offence punishable under Sections-30(a)/32/41/56(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

3. Allegedly, on the tip off, the informant along with police personnel conducted a raid and in that course, the petitioner is said to have been arrested with a plastic jerkin and 8 litres illicit liquor was recovered in that jerkin.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. As a matter of fact, no occurrence as alleged has

Patna High Court CR. MISC. No.52560 of 2024(2) dt.01-08-2024 2/2 ever taken place and entire prosecution version is fully concocted and fabricated. No incriminating articles has been recovered from possession of the petitioner. The petitioner is in custody since 28-06-2024.

5. Learned counsel appearing for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances the petitioner named above, is directed to furnish bail bond after two months from today and on doing so, the petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Sheikhpura in connection with Excise P.S. Case No. 278 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court with condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.
