The petitioner apprehends his arrest in connection with Excise Case No. C-III-282 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ill motive. From perusal of the seizure list, it appears that the alleged recovery has been made from the bamboo-bush. Further he submits that the petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.60544 of 2021(2) dt.15-04-2022 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional District and Sessions Judge-II-cum-Special Judge (Excise), Siwan in connection with Excise Case No. -282 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
