JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Marhowrah P.S.Case No. 380 of 2014 registered for the offences punishable under Section 302/34 of the Indian Penal Code. Petitioners are named in the first information report but admittedly, the informant is not an eye witness of the alleged occurrence. In course of investigation, some witnesses stated that prior to the alleged occurrence petitioners and other F.I.R named accused were quarreling with the deceased and after that all the accused along with deceased entered into their house and then alleged occurrence took place inside the house of accused persons

Taking note of the aforesaid fact as well as this aspect of the matter that petitioners are ladies and there is only allegation against them that they helped their respective husbands in committing the alleged crime, let petitioners in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in Marhowrah P.S.Case No. 380 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
