The matter has been taken up through virtual Court proceeding.
Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 504, 447, 506, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioners were allegedly causing lathi blow at the time of occurrence of murder when co-accused Shailesh Kumar Singh fired giving fatal blow to the deceased. Allegation of firing is also there against some other co-accused.
Patna High Court CR. MISC. No.10175 of 2021(2) dt.29-06-2021 2/2 Learned counsel for the informant vehemently opposed the prayer for bail.
Considering the nature of allegation against the petitioners and completion of investigation of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bagen Gola Police Station Case No. 98 of 2020, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the learned trial court.
