The petitioner apprehends his arrest in a case under different sections of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The petitioner and his brother Santosh Singh are alleged to have surrounded the informant, abused him by naming his caste and spit on him. It is submitted that the occurrence did not take place in public view. There was none at the place of occurrence. There is a litigation pending between the parties as the informant had earlier filed a case against Subodh Singh, the brother of the informant. Co-accused Santosh Singh has already been enlarged on regular bail.
Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.14947 of 2015 (2) dt.11-05-2015 2/2 petitioner is directed to surrender in the court below within four weeks from today and the court below shall, taking into consideration that similarly situated co-accused Santosh Singh has already been enlarged on regular bail, enlarge the petitioner on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Kalyanpur P.S. Case No. 281/14, subject to the conditions as laid down under Section 438(2) Cr.P.C.
