The petitioner seeks bail in connection with N.T.P.C. Police Station Case No. 16 of 2017 instituted for the offences under Sections 365 and 420 of the Indian Penal Code.

The petitioner has not been named in the FIR but only in the 164 statement of the victim girl, who is said to have sold off at the instance of the petitioner and 3 others to some persons.

Learned counsel for the petitioner has submitted that Chameli Devi who had taken the victim out of her

house to provide employment to her has been acquitted. Another accused person of this case with similar allegation as that of the petitioner viz Hriday Mandal has also been acquitted in the Trial.

The petitioner surrendered after he came to know of his implication in this case on the basis of 164 statement of the so called victim.

He is custody since 30.06.2022.

Regard being had to the afore-stated facts and also taking into account his clean antecedents, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with N.T.P.C. Police Station Case No. 16 of 2017.
