JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 302 and 34 of the Indian Penal Code. The allegation against the petitioners is of killing the daughter of the informant.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioner no.1 is the father-in-law of the deceased and petitioner no.2 is the mother-inlaw of the deceased. The alleged occurrence has taken place after twelve years of the marriage. It has been submitted that the son of the deceased was examined in course of investigation where he has categorically stated that out of four Sarees, which his father had brought during CHAT festival, one Saree he had given to his

Patna High Court Cr.Misc. No.11048 of 2016 (2) dt.25-04-2016 2/2 mother and for the said reason his mother had committed suicide. There is no specific allegation against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IIIrd, Samastipur in Khanpur P.S.Case No. 142 of 2015,subject to the conditions as laid down u/s 438(2) Cr.P.C.
