The petitioner apprehends his arrest in a case under Sections 452, 379, 409 of the Indian Penal Code. The informant alleged that the petitioner had gone to the house of the informant in his absence while his maidservant was present. When the informant came, some signed letter-pads from the bundle of birth certificate were found missing. It is submitted that the petitioner is Clerk in the Primary Health Centre and he has gone to the house of the Incharge Medical Officer for official purpose but on the next day, nobody has seen the petitioner in the house of the informant. On mere suspicion, the name of the petitioner has figured in the case. The petitioner has not taken the birth certificate.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.16430 of 2016 (2) dt.10-05-2016 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Araria in Jokihat P.S. Case No. 18/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
