The petitioner being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.
Accusation is of killing the sister of the informant by causing burn injury.
It is submitted by the learned counsel for the petitioner that the victim got incidental fire on 25.11.2014 where she died on 03.01.2015, thereafter the present First Information Report was lodged by the brother of the victim on 03.01.2015. The fardbeyan of the victim was also recorded in the hospital where she stated that she received accidental burn injury. The same has been
Patna High Court Cr.Misc. No.13951 of 2015 (2) dt.03-04-2015 brought on record vide Annexure-2. Subsequently, the informant has retracted from his initial version. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 02 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
