The petitioner seeks bail in connection with Deoria P. S. Case No.171 of 2020, instituted for the offences under Sections 302, 201/ 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 01.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case. The learned counsel for the petitioner submits that the informant alleges that his daughter was married to Ajay Das in the Year 2014. After marriage, the accused persons including the petitioner were demanding motorcycle and money. Thus, the informant suspects that his daughter has been killed by the accused persons for non-fulfilment of the dowry demand. The learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the allegation is based on suspicion. It is further alleged

No.60106 of 2021(2) dt.10-03-2022 2/2 that motorcycle and money was being demanded, but the F.I.R. does not disclose what was the amount, which was being demanded by the accused persons, which also gives an impression that the allegations are general and omnibus in nature. It is further submitted that the petitioner is brother-in-law and is separate in mess and property from Ajay Das.
The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case and is the brother-in-law of the husband of the deceased, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Sachin Kumar, learned Judicial Magistrate, 1st Class, West, Muzaffarpur in connection with Deoria P. S. Case No.171 of 2020.
The application stands allowed.
