ANJANA MISHRA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends her arrest in connection with a case registered for the offences punishable under Sections 302, 376, 341, 323, 325, 326/34 of the Indian Penal Code and Section 4 of the POCSO Act.

Learned Senior counsel for the petitioner submits that allegation against this petitioner is that she had employed the deceased in her house and the deceased had worked there for several months. He further submits that on many occasions the petitioner had permitted the deceased to communicate with her parents and on none of the occasions had the deceased made any

Patna High Court Cr.Misc. No.11071 of 2015 (7) dt.31-08-2015 P2/2 complaint against this petitioner. It is also submitted that a ridiculous allegation has been made against this petitioner under Section 376 which is highly improbable and absurd. Learned counsel after perusal of the case diary could not point out any cogent evidence to connect the petitioner with the occurrence. In view of the fact that there was no specific allegation made against this petitioner or even that she assaulted the deceased and that there has been no complaint against her at any point of time, let the petitioner Geeta Singh, in the event of her arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs.

10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned 1st Additional Sessions Judge, Patna, in connection with Buddha Colony P.S. Case No. 10/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
