2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 109, 191
(1) , 191 ( 2 ), 190, 126 ( 2 ), 115 ( 2 ), 118 (1) , 76, 303 ( 2 ), 352, 351 ( 2 ) and 351 (3) of BNS.
3 . The prosecution case in brief, is that informant namely Sunita devi alleged that on 20.01.2025 , at about 9 AM , all the accused persons including this petitioner armed variously , came at the house of informant and started abusing her and on protest, accused persons molested and assaulted her and also snatched gold earring worth Rs. 35,000/- Jitiya worth Rs. 17,500/-. It is further alleged that when husband of informant came to her rescue, accused persons assaulted him
Patna High Court CR. MISC. No.48935 of 2025(2) dt.31-07-2025 2/3 and took Rs. 5,000/- from him and threatened with dire consequences.
4. It is submitted on behalf of the petitioner that petitioner is not named in the F.I.R. she is innocent and has not committed any offence as alleged. Petitioner happens to be wife of co-accused Binod Bhagat who has been named in the F.I.R. During course of investigation , in the re -statement, informant named this petitioner as one of the co-accused. It is further submitted that for the same occurrence , this petitioner lodged Baijnathpur P S Case No. 11 of 2025 , against the present prosecution party and in retaliation , informant made her accused in her re -statement. Petitioner is lady and claims clean antecedent.
5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Saharsa in connection with Baijnathpur P.S. Case No. 08 of 2025 ,
