JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 23.02.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Balia P. S. case no. 270/2014 registered under sections 147, 448, 323, 324, 504 of the IPC as well as section 3/4 of the Prevention of witch Practices Act, 1999.

Petitioners are named in the first information report with omnibus allegation that they along with FIR named accused Rahul Kumar entered the house of the informant and called her Dyne and after that assaulted her with lathi and danta and in that course, FIR named accused Rahul Kumar gave khanti blow causing injury to informant's son.

Admittedly, co-accused Rahul Kumar is not petitioner here

Patna High Court Cr.Misc. No.6947 of 2015 (2) dt.23-02-2015 and it is Rahul Kumar who caused grievous injury to informant's son. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Balia P. S. case no. 270/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
