JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Town (Aurangabad) Police Station Case No. 136 of 2014 registered for the offences punishable under Sections 304 and 34 of the Indian Penal Code.

Petitioner was working as a lady doctor in Sadar hospital Aurangabad and accusation against her is that due to negligent act of the petitioner the informant's wife died in course of her treatment.

The contention on behalf of the petitioner is that the informant's wife was admitted in Sadar hospital, Aurangabad and

Patna High Court Cr.Misc. No.12015 of 2015 (2) dt.27-04-2015 2/2 the wife of informant gave birth to a female child by caesarian operation but subsequently, she developed some complications and died in course of her treatment.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Town (Aurangabad) Police Station Case No. 136 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
