The petitioner is apprehending his arrest in connection with Jamalpur P.S. Case No. 105 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323, 307, 325, 447, 354, 379, 504 and 324 of the IPC.

The prosecution story, in brief, is that the petitioner alongwith others armed with Lathi, Farsa, Iron rod and Mirchi dust in their hands reached in the house of the informant and coaccused Ram Udar Yadav ordered to murder the family members of the informant. This petitioner assaulted with Farsa on the head of the informant and when his sons and wife came to save their father and husband, co-accused Ram Chandra Yadav assaulted with iron rod to his son and Ram Udgar Yadav assaulted with Lathi to the wife of the informant, co-accused Pritam Yadav

Patna High Court Cr.Misc. No.21189 of 2016 (3) dt.27-06-2016 2/2 snatched one golden chain worth Rs. 60,000/-, co-accused Manoj Yadav and Ram Udgar Yadav took thumb impression on three blank stamp paper.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is a case and counter case between the parties. Injury has been sustained by both sides. There is admitted land dispute between the parties. A title suit is also pending and 107 Cr. P.C. proceeding is also pending between the parties.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Jamalpur P.S. Case No. 105/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biroul, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
