JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bandhuwakuraba P.S.Case No. 19 of 2017 registered under Section 392 of the Indian penal Code. Allegation in brief is that a road robbery was committed and one accused Chhotu Yadav was apprehended who disclosed the name of other associates.
Submission is that except disclosure of the name of petitioner by Chhotu Yadav, there is no other material. Neither any incriminating article has been recovered from the possession of the petitioner nor he was put on TIP for identification, moreover, Chhotu Yadav, who apprehended at the spot, was granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 48608 of 2017.

No.35555 of 2018(2) dt.21-06-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely , Pinku Yadav @ Anish Yadav @ Pinku Kumar @ Anish Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-III, Banka in connection with Bandhuwa Kuraba P.S. Case No. 19 of 2017.
