2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Manpur P.S. Case No. 49 of 2024 instituted for the offence under Sections 147, 149, 188, 341, 342, 332, 353, 307, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is accused of trying to free the arrested accused by assaulting the informant and the police team.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that from
Patna High Court CR. MISC. No.48710 of 2025(2) dt.05-08-2025 2/3 perusal of the FIR, it is clear that it is alleged that 14-15 persons surrounded the police vehicle and his name was disclosed by the apprehended persons. There is no specific allegation against this petitioner. It has also been submitted that similarly situated other co-accusd person has already been granted bail by learned co-ordinate Bench of this Court vide order dated 11.09.2024 in Cr. Misc. No. 51618 of 2024. The case of this petitioner stands of similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.
5. In contra, learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Manpur P.S. Case No. 49 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bihar Sharif, Nalanda subject to the conditions as laid
