Petitioner, already in custody, seeks bail in connection with Kanti P.S. Case No.545 of 2017 registered under Sections 400, 401, 413 and 414 of the Indian Penal Code. Allegation in brief is that on receiving information that some persons are trying to sell a looted truck, the police apprehended some of the accused persons including the petitioner along with the truck.

Learned counsel for the petitioner submits that the petitioner is the driver of the truck, it was not sold to anybody rather in confessional statement the petitioner disclosed that he intended to sell the truck and would have lodged a case of

No.34521 of 2018(2) dt.29-06-2018 2/2 looting the truck by unknown miscreants, only on the basis of the confessional statement made before the police, the petitioner has been implicated in this case though it is stated that it is a looted truck but it is not a looted one and the petitioner was in possession of the truck as he was the driver of the truck and no case of robbery of the truck was ever lodged. Having considered the aforesaid facts and circumstances, petitioner Balwant Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.
