1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 406, 420 and 465 of the Indian Penal Code.
3. The learned counsel for the petitioner submits that the petitioner contested the election of Sarpanch concealing his criminal antecedent and accordingly a complaint was made based on which the instant FIR came to be instituted. It is submitted that petitioner is in custody since 13.06.2024.
4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
5. Considering the submissions made by the learned
Patna High Court CR. MISC. No.53690 of 2024(2) dt.09-08-2024 2/2 counsel for the petitioner, the petitioner above-named, be released on regular bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nawkothi P.S. Case No. 180 of 2023.
6. It is made clear that in the event if the learned Trial Court comes to a conclusion that petitioner, after his release, is trying to delay the trial in any manner, in that event, the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner forthwith after recording reasons.
7. Accordingly, the instant regular bail application stands allowed.
