1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the same has been specifically pleaded at Para-3 of the anticipatory bail application. It is further submitted that order impugned inadvertently records that petitioner has criminal antecedent.
3. In view of the submission made by the petitioner, the defect as pointed out by the office is ignored.
4. The learned counsel for the petitioner, at the outset, submits that petitioner has been given notice under Section 41(A) of the Cr.P.C. and the police presently has not filed any
Patna High Court CR. MISC. No.51179 of 2025(2) dt.28-08-2025 2/2 application before the learned Magistrate seeking permission to arrest the petitioner, as such, the petitioner, for the present, does not have any apprehension of arrest and thus, seeks permission to withdraw the instant anticipatory bail application with liberty to the petitioner to file afresh, if need arises.
5. Permission is accorded.
6. Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
