JUSTICE SHIVAJI PANDEY ORAL ORDER 30-07-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Sakra P.S.Case No. 180 of 2014 registered u/s 406, 304(B) IPC. In the present case, allegation has been made that the in-laws of the victim lady had taken her ornaments and compelled her to go to her parental place and when she gave a call from there, reply was given by the husband that it would be better if she died. Thereafter the victim committed suicide. But from Annexure-2 it appears that the victim lady was of dominating nature and always pressed her husband to remain with her which led to quarrel from time to time, was the main cause behind the occurrence.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within six weeks, petitioner
Patna High Court Cr.Misc. No.9347 of 2015 (4) dt.30-07-2015 2/2 Khushnoor Iqbal @ Bablu is directed to be released on anticipatory bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in Sakra P.S.Case No. 180 of 2014, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure. He will co-opiate the investigation, also submit himself for Police interrogation whenever it is so required and in failure, the court below will be at liberty to pass appropriate order, including cancel his bail bonds.
