2. In the present case, the petitioner seeks bail in connection with Patna By-pass P.S. Case No. 33 of 2026 dated 27.01.2026, registered for the offences punishable under Sections 8, 17(b) and 18(b) of the NDPS Act.

3. As per the prosecution case, during vehicle checking two persons riding a motorcycle tried to run away on seeing the Police party and both of them were apprehended on suspicion. From their possession, recovery of one kilogram of opium like substance was made. The apprehended co-accused disclosed the name of this petitioner who sold them opium.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. From the FIR it is apparent

No.49018 of 2026(2) dt.22-07-2026 2/3 that nothing incriminating has been recovered from person or possession of this petitioner and except for suspicion and confessional statement of the co-accused, there is no substantive material against the petitioner. There is no call detail record (CDR) to link the petitioner with other co-accused persons besides the co-accused Shubham with whom the petitioner has met only once or twice in a family function. Learned counsel next submits that petitioner is having clean antecedent. Learned counsel lastly submits that petitioner is in custody since 11.06.2026.

5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery has been shown from the petitioner and further considering the quantity of recovered contraband which is less than commercial quantity and not recovered from this petitioner and also considering petitioner's clean antecedent and his period of custody, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge /

Patna High Court CR. MISC. No.49018 of 2026(2) dt.22-07-2026 3/3 Special Judge (NDPS), Patna / concerned Court, in connection with Patna By-pass P.S. Case No. 33 of 2026, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Arun Kumar Jha, J) Shahnawaz/- U T
