JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bihta P.S. Case No.968 of 2017 registered under Sections 447, 436 and 120B read with 34 of the Indian Penal Code. Considering that save and except suspicion raised against the petitioners in the offence alleged there is no other material to support that the petitioners had any hand in commission of crime and there is motive for implication as the informant and the petitioner no.1 were on logger heads and were contesting various cases for the post of Principal of the college in question, in the event of arrest or surrender in the court below

Patna High Court Cr.Misc. No.35195 of 2018 (2) dt.28-06-2018 2/2 within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Danapur in connection with Bihta P.S. Case No.968 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
