The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 395 and other ancillary sections of the Indian Penal Code. Police seized stolen truck and recovered 1570 cartoon foreign liquor loaded on it and from possession of the petitioner a forged driving license was recovered as per paragraph 29 of the case diary.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and for the stolen truck another case, namely, Arwal Police Station Case No. 261/2014

Patna High Court CR. MISC. No.60667 of 2021(2) dt.11-02-2022 2/2 has also been registered. Test Identification Parade has not been carried out till date. Petitioner is in custody since 19.3.2020 and Charge sheet has already been submitted. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge XIII, Rohtas at Sasaram in Sessions Trial No. 42 of 2016.
