2. Petitioner seeks regular bail in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, 222.880 liters of foreign liquor was recovered from the house of the petitioner and 3.24 liters of foreign liquor was recovered from the dicky of the motorcycle bearing registration no. UP56AL9747, which was parked in front of the petitioner's house.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No incriminating material has been recovered from conscious possession of the petitioner and he has got no concern

Patna High Court CR. MISC. No.50173 of 2026(2) dt.22-07-2026 2/2 with the aforesaid recovery. The petitioner has got two criminal antecedents, similar in nature in which he is on bail. Petitioner is in custody since 10.06.2026.

5. Learned A.P.P. for the State vehemently opposes the regular bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the regular bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Exlusive Special Excise Court, Saran at Chapra in connection with Chapra Muffasil PS Case No. 395 of 2026.
