The petitioners apprehend their arrest in a case registered for the offence under Section 379, 504 & other allied sections of the Indian Penal Code.
As per the prosecution case, on 1803.2022,while the informant was sitting at the door of his uncle's house, all the F.I.R. named accused, including petitioners, armed with weapons, attacked the informant and his family members. They
Patna High Court CR. MISC. No.50766 of 2022(2) dt.19-12-2022 2/2 are also alleged to have molested the female members of the family and took away cash of Rs. 10,000/- from informant. Injury caused by petitioners are simple in nature. Case and counter case. Both sides sustained injury. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, District - Aurangabad in connection with Goh P.S. Case No. 73 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
