The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The informant has lodged this criminal case against the petitioner only on suspicion of stealing the Bolero vehicle bearing Registration No.BR-04Q-8164.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner had made payment of Rs.3,50,000/- to the informant in respect of purchasing the Bolero vehicle but the informant did not hand over the vehicle to the petitioner. He further submits that the informant has

Patna High Court CR. MISC. No.7146 of 2021(4) dt.07-04-2022 2/2 returned Rs.3,00,000/- but refused to return the rest of the amount of Rs.50,000/- to the petitioner. He further submits that recovery of stolen Bolero in question has not been made as yet. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gopalganj in connection with Mohammadpur P.S. case No.129 of 2020/ G.R. No.2080 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
