The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 409, 323, 504 and 307 of the Indian Penal Code.

Prosecution case in nutshell is that complainant is the Director of Sarvodaya Proficient Nidhi Limited and accused Director-cum-Chief Branch Manager of the said company and the accused persons misappropriating their power and transferred all the account of said limited and withdraw about one and half crore rupees and misappropriate the same in his personal use.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No. 60447 of 2021(3) dt.12-07-2022 2/2 that the petitioner has falsely been implicated in this case. He further submits that petitioner is not named in the FIR. Petitioner has lodged FIR against the present informant as well as Ravindra Chaurasia in respect of taking out the money from the said company. He further submits that petitioner has not transacted any amount from the said company. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Barauni (Chakia) P.S. Case No. 83 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
