2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 126(2), 115(2), 117(2), 109(1), 351(2), 352, 3(5) of the B.N.S. 2023, registered in connection with Chhatapur P.S.Case No. 140 of 2025.

3. As per allegation, the accused persons, including the petitioner, were constructing a house on the land of the informant. On protest, the accused persons started hurling filthy languages. Thereafter, the petitioner assaulted the informant with a lathi, causing fracture injury on his shoulders.

4. The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated.

Patna High Court CR. MISC. No.48791 of 2025(2) dt.11-08-2025 2/2 There is land dispute between the parties and injury no.5, which is attributed to the petitioner, is grievous in nature and tenderness on both shoulders of the informant was found. The petitioner is in custody for three months.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail by submitting that the petitioner badly assaulted the informant on his shoulder and made him injured. The injury is grievous in nature.

Considering the above facts and circumstances, clean antecedents and the period of incarceration i.e. for a little over three months, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Supaul in connection with Chhatapur P.S.Case No. 140 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
