The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 77 of 2024 dated 21.04.2024, registered under Sections 363 and 366A of the Indian Penal Code and section 8 of the POCSO Act.

As per the prosecution case, the petitioner and other co-accused persons are alleged to have kidnapped the daughter of the informant for the purpose of marriage. The petitioner and the victim girl were in a relationship. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There

Patna High Court CR. MISC. No.52626 of 2024(2) dt.07-08-2024 2/2 is no specific allegation of kidnapping is against the petitioner rather the allegation is general and omnibus. The petitioner has no criminal antecedent and he is in custody since 28.04.2024. 5.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for bail. And submits that the petitioner is a married person and he should not have a relationship with such a young girl. 6.

Considering the facts and circumstances of the case and also period of custody, this bail application is allowed. 7.

Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of 7th A.C.J.M. cum Special Judge (POCSO), East Champaran, Motihari in connection with Rajepur P.S. Case No. 77 of 2024.
