The petitioner has preferred this application for grant of regular bail in a case registered under section 30 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, while the two accused persons managed to escape, a total of 1085 litres of liquor was recovered from a Bolero vehicle. It is further stated that on examination of the mobile phone recovered from the said vehicle it transpired that the driver of the vehicle was one Md. Amjad Hussain and the other person who had managed to escape was the petitioner herein.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any

Patna High Court CR. MISC. No.60748 of 2021(2) dt.28-01-2022 2/2 incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedents. He is in custody since 2.8.2021 and charge sheet sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having been arrested at the spot, the Court directs the petitioner to be enlarged on bail in connection with Amas P.S. Case no. 220 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Gaya.
