The petitioners are apprehending their arrest in connection with Raghunathpur P.S. Case No. 132 of 2014 for the offences instituted under Sections 406, 420, 467 and 504/34 of the Indian Penal Code.
As per the prosecution case the informant Nathuni Sah and one of the cited witness namely, Muzaffar Hussain had given worth of Rs.75,000/- and 20,000/- to the petitioners for the purpose of getting the job in the Gulf country, but when these petitioners issued Viza and Air Ticket in the name of the
informant and one of the cited witness and on enquiry the same was found a bogus when the informant and witness asked to the petitioners and demand their money upon which the accused persons denied to return the money and threatened them to the dire consequences.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have falsely been implicated in the present case. The alleged date of occurrence is 10.06.2010 and a complaint was filed regarding the same on 25.06.2014. Delay has not been explained. It is further submitted that the petitioners are ready to deposit an amount of Rs.25,000/- jointly in the court below which shall be subject to the final disposal of the case.
On behalf of the State, it has been submitted that the petitioners are named in the complaint/F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs.25,000/- jointly in the court below which shall be subject to the final disposal of the case and on doing so, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Raghunathpur P.S. Case No. 132 of
2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) B.Kr./- U T
