In view of the Full Bench decision of this Court in case of Arun Kumar Singh Vs. State of Bihar & Ors. and other analogous cases, reported in 2016 (1) PLJR 451, the respondent Bank cannot be treated to be 'State' within the meaning of Article 12 of the Constitution of India and, is, therefore, not amenable to writ jurisdiction of this Court.

This application, therefore, cannot be maintained and, is thus, dismissed.

It goes without saying that the petitioner shall be at liberty to question the impugned action before appropriate forum in accordance with law. I have not gone into the merits of the grounds taken by the petitioner to question the correctness of the impugned action.
