2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Sections 3 & 4 of the D.P. Act pending in the learned court below.
3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is ready to keep his wife with full honour & dignity and learned counsel for the complainant also stated that the complainant is ready to live with the
Patna High Court CR. MISC. No.51344 of 2023(2) dt.11-08-2023 2/2 petitioner.
4. Considering the facts aforesaid, let the petitioner, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on provisional bail for a period of four weeks, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Complaint Case No.6037/2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
5. The provisional bail bond of the petitioner shall be confirmed by the learned court below after verifying the fact that complainant is living with the petitioner with full honour and dignity.
