JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code and section 8 of the POCSO Act. As per the prosecution case, this petitioner as well as other accused persons kidnapped the daughter of the informant for the purpose of marriage.
Learned counsel for the petitioner submits that the thrust of accusation is against co-accused Chhotu Kumar and this petitioner happens to be his elder brother. The victim in her section 164 Cr. P. C. statement (Annexure 2 to the supplementary affidavit) has stated that she has married Chotte out of her own sweet will. She has not made any allegation against the petitioner and her age in the said statement has been mentioned as 17 years. Petitioner has claimed clean antecedent and he is in custody since 9.7.2021. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
