JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 341, 323, 354, 504/34 of the Indian Penal Code and Section 3 (i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The petitioner submits that he has been falsely implicated because of is land dispute. The informant obstructed him from ploughing his field, for which a proceeding under Section 107 Cr.P.C. was recommended on his complaint filed on 16.08.2015.
On the other hand, the informant alleged that the petitioner abused his wife Gayatri Devi.
Having regard to the facts of the case, if the petitioner
Patna High Court Cr.Misc. No.11616 of 2016 (2) dt.01-04-2016 2 / 2 surrenders before the court below and prays for regular bail, the same would be disposed of preferably on the same day also taking into consideration that he had also filed a petition against the informant.
With the aforesaid observation, this application stands disposed of.
