The petitioner apprehends his arrest in Baniyapur P.S. Case No.44/2018, registered under Sections 489(a)(b)(c) and 34 of the Indian Penal Code.

The gist of the case is that the police arrested coaccused Rajesh Rai on chase and another accused managed to flee away. Rajesh Rai disclosed the name of the petitioner. On such huge quantity of counterfeit currency was recovered from the possession of co-accused Rajesh Rai.

Learned counsel for the petitioner submits that the petitioner was not arrested on the spot and nothing has been recovered from the possession of the petitioner but it appears that besides the fact that police arrested co-accused Rajesh Rai, who

Patna High Court Cr.Misc. No.34741 of 2018 (2) dt.03-07-2018 2/2 disclosed the name of the petitioner on the spot, from possession of Rajesh Rai, fake currency of different denominations was recovered. The petitioner has got criminal antecedent. He is accused in as many as three criminal cases.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected in connection with Baniyapur P.S. Case No.44/2018, pending in the court of learned A.C.J.M.-XI, Saran at Chapra. If the petitioner surrenders in the court below, the learned court below shall consider the regular bail petition of the petitioner on its own merit without being prejudiced by this order.
