10-04-2015 Heard Sri Kumar Praveen, learned counsel for petitioners and learned Addl. Public Prosecutor. Three petitioners, apprehending their arrest in C.R. No. 1411 of 2013 (T.R. No. 4132 of 2014) registered for offence under Sections 341, 323, 354, 447, 448, 427 & 504 of the Indian Penal Code, have prayed for grant of anticipatory bail. Learned counsel for petitioners submits that due to village politics, petitioners have been made accused in the present case. He further submits that save & except offence under Section 354 of the Indian Penal Code, all the sections are bailable and there is no such accusation against petitioners showing commission of offence under Section 354 of the Indian Penal

Keeping in view the nature of accusation, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail.
In the event of arrest or surrender within a period of eight weeks from today, the petitioners namely Rameshwar Pandit @ Nanki Pandit, Bindeshwar Pandit and Bhola Pandit shall be entitled to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Rabindra Kumar, learned J.M. 1st Class, Samastipur, in connection with C.R. No. 1411 of 2013 (T.R. No. 4132 of 2014) under conditions as contemplated under Section 438 (2) of the Cr.P.C.
