JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 This application for grant of regular bail arises out of Supaul P.S. Case No. 624 of 2017, dated 18.10.2017, instituted for the offences under Sections 392 and 120(B) of the Indian Penal Code.

The informant, while coming back from his shop was robbed of his belongings as well as the motorcycle which he was riding. One Dilip Yadav was named in the F.I.R. along with his four associates.

Learned counsel for the petitioner has submitted that he has not been named in the F.I.R. He has been remanded in the present case from another case in which

Patna High Court Cr.Misc. No.35967 of 2018 (3) dt.09-07-2018 2/2 he is an accused. The implication of the petitioner in the present case is only on the basis of confession made by aforesaid Dilip Yadav. The allegation against the petitioner is of using the looted motorcycle. The motorcycle has not been put on test identification parade.

The petitioner is in custody since 09.04.2018. Regard being had to the period of custody of the petitioner above named and the nature of accusation levelled against him, he is directed to be released on bail on his furnishing bail-bond in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S.
