The instant application for regular bail has been filed by the petitioner registered for the offence punishable under Sections 366(A) of the Indian Penal Code.

Prosecution case relates to abduction of minor daughter of the informant by the petitioner, who is tutor, for the purpose of marriage while she had gone to attend tuition class. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is a married man and father of three children. Victim has not made specific allegation of physical abuse or misbehave against the petitioner. She has received injury by goods train. Petitioner was badly injured in saving the

Informant attached the house of the petitioner on 17.12.2022 for which wife of the petitioner filed a complaint case lodged as Bodhgaya PS Case No. 288 of 2023. Petitioner is languishing in judicial custody since 20.3.2023.

Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Bodhgaya P.S. Case No. 814 of 2022.
