2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 118(2), 109, 76, 303(2), 352 & 3(5) of the Bhartiya Nyaya Sanhita.

3. As per F.I.R., on 24.07.2024, all the accused persons named in the F.I.R. including these petitioners attacked informant side with deadly weapons, as a result of which, five persons from informant's side sustained injuries.

4. Learned counsel for the petitioners submits that petitioners and informant are Gotiya and due to dispute over

Patna High Court CR. MISC. No.54879 of 2025(3) dt.08-09-2025 2/3 pathway, Maarpeet took place between the parties, in which, both sides sustained injuries. Case and counter case. Allegation of assault is general and omnibus. Petitioners claim clean antecedent.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that though, against petitioner nos. 1 & 2, there is general & omnibus allegation, but there is specific allegation of assault against petitioner no. 3 (Annu Devi) that she assaulted on the right hand of informant and doctor has found the injury grievous in nature.

6. Considering the nature of injury, the prayer for anticipatory bail of petitioner no. 3 (Annu Devi) is rejected.

7. So far as petitioner no. 1 & 2 are concerned, there is general & omnibus allegation and no specific overt act has been alleged against them, in the event of their arrest/surrender within a period of eight weeks from today, they are directed to be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Muffasil P.S. Case No. 467 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

8. This anticipatory bail application is, accordingly, disposed of.
