The petitioners apprehend their arrest in Barun P.S. Case No.85/2018, registered under Sections 379, 411, 420, 34 of the Indian Penal Code, Section 4/40 of M.M. Rules and Section 15 of Environment Protection Act.
The police intercepted 31 tractors loaded with sands and alleged that the driver and owner of the tractor illegally took sand by the bank of the river and they were carrying the sand. Learned counsel for the petitioners submits that the petitioners are owner and driver of the tractor bearing registration no.BRGA-9263. The driver of the tractor was carrying the sand on valid permit. No theft of sand was committed. Valid permit is

Taking into consideration of the fact and nature of allegation made against the petitioners, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Barun P.S. Case No.85/2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
