The petitioner seeks bail in Special Case No. 47 of 2018 arising out of Beur P.S. Case No. 146 of 2018, registered for the offences punishable under Sections 324, 307, 353, 324, 511 and 120(B) of the Indian Penal Code and section 3/5 of Explosive Substance Act and sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Name of petitioner has come on the basis of confessional statement of coaccused. Similarly situated co-accused have been granted bail by a coordinate Bench of this court vide order dated 15.07.2019

Patna High Court CR. MISC. No.48391 of 2019(3) dt.20-09-2019 2/2 passed in Cr. Misc. No. 31637 of 2019 and order dated 06.05.2019 passed in Cr. Misc. No. 29042 of 2019. In view of the nature of allegation and the fact that petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner above-named on bail in connection with Special Case No. 47 of 2018 arising out of Beur P.S.
