Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 341, 379, 447, 34 of the I.P.C.

It is alleged that accused persons including the petitioners were cutting the gram crop of the informant and when protest was made the accused persons assaulted the informant and taken away the crops.

It is submitted by learned counsel for the petitioners that accusation has been levelled in the background of serious land dispute. The informant has not received any injury as injury report is not on record. A statement to that effect has been made in para 6 of the petition. It is further

Patna High Court Cr.Misc. No.45536 of 2014 (2) dt.24-12-2014 2/2 submitted that petitioners are accused in one case prior to the present one in which they are on bail. Though one other case has been lodged against the petitioner Nos. 1 and 2 subsequent to lodging of the present case.

Considering the nature of accusation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kajraili P.S. Case No. 38 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
