Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Unknown persons committed robbery. Name of the petitioner surfaced in the confessional statement of co-accused Jairam Kumar. Petitioner has stated on oath that co-accused Jairam Kumar has already been allowed bail by the learned court below. Further, submission is that nothing has been recovered from possession of the petitioner. He is in custody since 10.04.2018. However, he was never put on TI Parade during investigation.

Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.37634 of 2018 (2) dt.06-07-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Salimpur Police Station Case No. 114 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
