2. The petitioner seeks bail in connection with Bagaha P.S. Case No. 679 of 2023, registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 34 of the Indian Penal Code
3. As per prosecution case, it is alleged that all the accused persons including this petitioner established a private bank in which the complainant and the witnesses were employed on commission basis and they deposited nearly an amount of Rs. 20 lakhs of various customers, but the payment of the account holders was not made despite assurance given by the petitioner and other co-accused persons.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.57651 of 2024(3) dt.25-10-2024 2/2 petitioner is innocent and has falsely been implicated in this case. The charge-sheet has already been submitted. Similarly situated co-accused Satyadev Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 28.08.2024 passed in Cr. Misc. No. 59958 of 2024. Petitioner is in custody since 11.04.2024.
5. Learned A.P.P. appearing on behalf of the State opposed the prayer for bail.
6. Having considered the aforesaid facts and circumstances of the case and similarly situated co-accused has already been granted bail, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Bagaha West Champaran in connection with Bagaha P.S. Case No. 679 of 2023.
