JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 33 of 2018 arising out of Sultanganj P.S.Case No. 80 of 2018 registered under Sections 11, 17 and 20(b) of the Narcotic Drugs and Psychotropic Substance Act.
Allegation in brief is that one co-accused earlier was apprehended and 3.750 Kg Ganja was recovered from his possession, who disclosed that petitioner used to sell Ganja thereafter police raided and from his cart 12 sachets, containing 04 GRAMS each, in total 46 Grams, were recovered. Submission is that petitioner was not apprehended at the spot and alleged recovery is from his Thela (cart) of only 46 Grams and has no criminal antecedent.

Aftab @ Kallu, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge at Patna cum Special Judge, NDPS Act in connection with Special Case No. 33 of 2018 arising out of Sultanganj P.S. Case No. 80 of 2018 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
