JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,342,364A,307 and 379 of the Indian Penal Code and section 27 of the Arms Act. The prosecution case is that on refusal to make payment of extortion of rupees eight lacs the petitioner fired on the chest of the informant when the co accused Rohit Das fired causing injury on the back and thereafter took mobile and Pulsar motorcycle of the informant.
It is submitted by the learned counsel for the petitioner that the medical opinion does not corroborate the accusation. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.12881 of 2016 (2) dt.30-03-2016 2/2 Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Laxmipur P.S. Case No. 229 of 2015 pending in the court of learned J.M. Ist Class, Jamui.
This application is disposed of with the aforesaid observation/direction.
