JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 6.9.2017 passed in Cr.Misc.No.40697 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that nine months period has already expired and there is no substantial progress in the trial and though some witnesses have been examined but other prosecution witnesses are yet to be examined, as stated in paragraph-14 of the petition.

Heard learned APP also.

Having heard both sides and in the facts and circumstances and considering the allegation of commission of rape, I am not inclined to grant bail to the petitioner.
