2. The petitioner seeks bail in connection with Cyber P.S. Case No. 01 of 2023, dated 23.06.2023, instituted for the offences under Sections 406, 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code and Sections 66, 66(C), 66(D) and 66(F) of the I.T. Act.
3. As per the prosecution case, the informant, the Sub-Inspector of Police, on secret information caught one Pankaj Kumar, who gave description of his gang
Patna High Court CR. MISC. No.52139 of 2025(2) dt.12-08-2025 2/3 involved in cyber crime. The other co-accused persons disclosed the name of the petitioner as one of the members of the gang.
4. The learned counsel for the petitioner submits that there is no specific allegation against the petitioner and he has falsely been implicated in this case. No incriminating material has been recovered from the possession of the petitioner. The petitioner has got no criminal antecedent and he is in custody since 22.05.2025. The two other similarly situated co-accused, namely, Pankaj Bind @ Pankaj Kumar and Lalan Singh have been granted regular bail by different Benches of this Court vide orders dated 29.02.2024 and 02.08.2024 passed in Cr. Misc. No. 79491 of 2023 and Cr. Misc. No. 42424 of 2024 respectively.
5. The learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Having regard to the facts and circumstances
Patna High Court CR. MISC. No.52139 of 2025(2) dt.12-08-2025 3/3 of the case as also the fact that the similarly situated coaccused persons have been granted bail by different Benches of this Court, let the petitioner above-named be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Cyber P.S. Case No. 01 of 2023.
7. The application stands allowed.
